1. Acceptance of Terms
Agreement
By accessing or using BrandPartnership (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Platform.
Eligibility
You must be at least 18 years old and have the legal authority to enter into contracts on behalf of yourself or your organisation. By using the Platform, you represent that you meet these requirements.
Updates to Terms
We may update these Terms from time to time. We will notify you of material changes. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
2. Platform Use
Permitted Use
The Platform is provided for the purpose of connecting property owners with brands seeking sponsorship and partnership opportunities. You may use the Platform only for lawful purposes consistent with these Terms.
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use.
Prohibited Conduct
You may not: (a) post false or misleading information; (b) scrape or harvest data from the Platform; (c) circumvent any security measures; (d) use the Platform to spam or harass other users; (e) impersonate any person or entity; or (f) violate any applicable law.
3. Listings & Content
Accuracy of Listings
Property owners are solely responsible for the accuracy of their listings, including audience data, reach metrics, and pricing. BrandPartnership does not verify listing data and makes no representations about its accuracy.
Content Ownership
You retain ownership of content you submit to the Platform. By submitting content, you grant BrandPartnership a non-exclusive, worldwide, royalty-free licence to display and distribute that content on the Platform.
Content Removal
We reserve the right to remove any listing or content that violates these Terms, is misleading, or is otherwise objectionable, without prior notice.
4. Transactions & Partnerships
Facilitation Only
BrandPartnership facilitates introductions between brands and property owners. We are not a party to any partnership agreement, sponsorship deal, or transaction between users.
No Guarantee of Deals
Submitting an enquiry does not guarantee a partnership. All commercial terms, contracts, and payments are negotiated and agreed directly between the brand and the property owner.
Disputes Between Users
Any disputes arising from a partnership or transaction are solely between the parties involved. BrandPartnership has no obligation to mediate or resolve such disputes.
5. Fees & Payments
Platform Fees
Access to the Platform may be subject to subscription or transaction fees as described on our pricing page. All fees are in Indian Rupees (INR) unless otherwise stated.
Refunds
Subscription fees are non-refundable except as required by applicable law. If you believe you have been charged in error, contact us within 14 days of the charge.
6. Intellectual Property
Platform IP
All intellectual property rights in the Platform — including software, design, trademarks, and content created by BrandPartnership — are owned by or licensed to us. You may not copy, modify, or distribute our IP without written permission.
Feedback
If you provide feedback or suggestions about the Platform, you grant us the right to use that feedback without restriction or compensation to you.
7. Disclaimers & Limitation of Liability
No Warranties
The Platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.
Limitation of Liability
To the maximum extent permitted by law, BrandPartnership shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, even if we have been advised of the possibility of such damages.
Maximum Liability
Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the fees you paid to us in the 12 months preceding the claim.
8. Governing Law & Disputes
Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
Dispute Resolution
Before initiating legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at hello@brandpartnership.in. We will try to resolve the dispute within 30 days.
9. Termination
By You
You may close your account at any time by contacting us. Termination does not entitle you to a refund of any fees paid.
By Us
We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. We will provide notice where reasonably practicable.
